Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the ShipScout platform, available at shipscout.ai, sales.shipscout.ai, and any related applications, APIs, or services (collectively, the “Service”) operated by ShipScout (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. The Service
ShipScout provides a global trade-intelligence platform that enables exporters, importers, and analysts to search, filter, and analyse customs and shipment data sourced from public records across 80+ countries. The Service is offered as a subscription on a monthly, half-yearly, or annual basis.
2. Eligibility & account
- You must be at least 18 years old and legally able to enter into binding contracts in your jurisdiction.
- You agree to provide accurate, current, and complete information at sign-up and to keep it updated.
- You are responsible for safeguarding your password and for any activity carried out under your account.
- One subscription = one human user. Sharing credentials, scraping the platform, or providing access to non-licensed users is prohibited.
3. Subscription, fees & billing
- Plan fees, billing cycle (monthly / 6-month / annual), and credit allowances are shown on the pricing page or in the offer/invoice issued to you before payment.
- All fees are payable in advance, in Indian Rupees (INR), via the payment gateway integrated with the Service (currently Cashfree Payments).
- Subscriptions auto-expire at the end of the paid term unless renewed. We do not auto-debit or auto-renew without your explicit re-payment.
- GST, where applicable, is charged in addition to the listed fee.
- Failure to pay an invoice within seven (7) days of issue will result in suspension of access until the dues are cleared.
4. Cancellation & refunds
Cancellation and refund eligibility is governed by our Refund Policy, which forms part of these Terms.
5. Acceptable use
You agree not to:
- Resell, redistribute, or commercially exploit the data delivered through the Service except with a written enterprise / API licence;
- Use any automated scraper, crawler, or headless browser to extract data beyond what is exposed through the documented Service interfaces;
- Attempt to circumvent the credit / quota system, share login credentials, or operate multiple accounts to evade limits;
- Use the Service for any unlawful purpose, including violation of export controls, sanctions, or money-laundering regulations;
- Reverse-engineer, decompile, or attempt to derive the source code of the Service.
6. Data sources & accuracy
The Service aggregates data from publicly available customs filings, government release notes, and licensed third-party providers. While we make reasonable efforts to keep the data accurate and current, ShipScout makes no warranty as to completeness or fitness for any particular purpose. You agree that decisions made based on the data are taken at your own risk.
7. Intellectual property
The Service, including all software, design, branding, and aggregated data layouts, is owned by ShipScout and protected under Indian and international copyright and trade-mark laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service during your active subscription.
8. Confidentiality
You agree to treat any non-public information, pricing, lead lists, or platform features shared with you under a paid plan as confidential, and not to disclose them to any third party.
9. Limitation of liability
To the maximum extent permitted by law, ShipScout's aggregate liability arising out of or relating to the Service shall not exceed the fees actually paid by you in the three (3) months immediately preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, business, or data.
10. Termination
We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms, attempt to abuse the credit system, or use the Service for any unlawful purpose. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (intellectual property, limitation of liability, governing law) will continue to apply.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified to you by email or in-product banner at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana.
